Plaintiff v. Driver

The Plaintiff was a passenger in a motor vehicle operated by the Defendant, his friend, who lost control of his car and crashed into a tree on a roadway in Lexington, Massachusetts.  The Plaintiff had to be removed from the vehicle with jaws of life, and was airlifted to a nearby hospital.  His injuries included burns on his foot, torn knee ligaments and a fractured pelvis, both of which required surgical intervention. The Plaintiff was hospitalized for over 30 days and underwent significant long term rehabilitation as part of his recovery.

The Plaintiff hired Boston, Massachusetts personal injury attorney, Keith L. Miller, who filed a negligence action against the driver in Middlesex Superior Court.  There were issues in the case associated with both parties presence at a party just prior to the accident and the consumption of alcohol. Attorney Miller successfully negotiated a $300,000 settlement with Defendant’s insurer.
